Petitions Filed by Duterte Siblings before the SC
The Duterte siblings filed petitions to the Supreme Court over the continued detention of their father, former President Rodrigo Duterte, under the custody of the International Criminal Court (ICC).

again last November 28. The ruling came with a unanimous decision among the judges who believe that the former President should remain within the perimeters of the ICC detention center in The Hague, Netherlands.
Former Pres. Duterte was represented by his lawyer, Nicholas Kaufman, at the hearing over his ICC interim release appeal. The former Chief Executive waived his rights to personally appear at the hearing.
According to Kaufman, they might refile the interim release plea again. The British-Israeli Lawyer stressed that they did their best on the appeal for the temporary release of the former President.
Davao Cong. Paolo Duterte asked the Supreme Court to issue a writ of habeas corpus so former Pres. Rodrigo Duterte could be discharged from confinement and detention. The eldest son of the former President also asked the high court to “prohibit respondents from cooperating with the ICC and Interpol relating to the application of the Rome Statute in the Philippines”.

, on the memorandum, the Duterte siblings expressed their claim that the extradition and surrender of the Philippine government of their father is allegedly illegal. Former presidential spokesman Harry Roque assisted by the children of his former boss in the memorandum.
On social media, Roque stressed that the memorandum was made to emphasize that the ICC allegedly has no jurisdiction over the Philippines after the country withdrew from the Rome Statute in 2019.
