As Christmas parties approach, DOLE reminded companies to respect the rights and personal choices of their employees, especially when it comes to party activities. The labor department clarified that workers who are forced to dance or join production numbers during Christmas celebrations have the right to file a complaint.
The agency has issued the announcement after discussions spread on social media about whether employees could report mandatory dancing at company events. DOLE explained that Christmas parties should be inclusive and respectful.
Employers are encouraged to plan activities that consider different cultures, religious beliefs, and personal preferences. What is fun for some may be uncomfortable or stressful for others.
The National Labor Relations Commission also made it clear that forcing an employee to perform, especially with threats of punishment, is not allowed. Under the Labor Code, disciplinary action is only justified for work-related reasons such as serious misconduct, neglect of duty, or offenses connected to the job.
Dancing at a Christmas party is not part of an employee’s job description and should never be treated as a requirement. If an employee is pressured to join an activity and is warned of penalties for refusing, they may seek help from the NLRC and even claim damages.
Complaints may also be filed if the situation leads to unfair treatment, hostility in the workplace, or a work environment so difficult that the employee feels pushed to leave. In some cases, the situation may also fall under the Safe Spaces Law if harassment or humiliation is involved.
DOLE emphasized that celebrations should bring joy, not fear or stress. While voluntary participation in fun activities is welcome, no one should be forced or embarrassed into joining. Employers are reminded that respect and understanding create a healthier workplace.
